Agreement to Terms

These Terms of Service ("Terms") govern your use of Divine Tree Service's website and services. By accessing our website or using our services, you agree to be bound by these Terms.

Divine Tree Service is a licensed tree care and removal contractor serving Northern California. These terms apply to all services including tree removal, stump grinding, land clearing, wood chipping, and emergency tree services.

Service Offerings

Divine Tree Service provides the following services in Northern California:

  • Professional tree removal and cutting
  • Stump grinding and complete root removal
  • Land clearing and brush removal
  • Wood chipping and mulching services
  • Emergency tree removal and storm cleanup
  • Tree health assessment and consultation
  • Brush and field mowing services

Service Area

Our services are available throughout the Greater Sacramento area and Northern California including but not limited to Sacramento, Elk Grove, Roseville, Folsom, Citrus Heights, Rancho Cordova, Davis, Woodland, and other communities within our 50+ mile service radius.

Estimates and Contracts

Free Estimates

We provide free estimates for all tree removal and arborist services. Estimates are valid for 30 days unless otherwise specified. Final pricing may vary based on actual site conditions, tree health, and safety requirements discovered during assessment.

Written Contracts

All projects require a written contract outlining scope of work, safety procedures, cleanup requirements, timeline, and payment terms. Contracts must be signed by both parties before work begins.

Changes to Work

Any changes to the original scope of work must be approved in writing and may result in additional charges. Additional tree removal, stump grinding, or cleanup services will require written change orders for your approval.

Payment Terms

Payment Schedule

Payment terms and schedules will be detailed in your individual contract based on the scope and nature of your tree service project. This allows us to provide flexible payment options tailored to your specific needs.

Safety and Liability

Safety Procedures

All work is performed according to industry safety standards and OSHA regulations. We conduct thorough site assessments and implement appropriate safety measures for each project.

Insurance Coverage

Divine Tree Service carries comprehensive general liability insurance and workers' compensation insurance. We are fully licensed, bonded, and insured. Proof of insurance is available upon request.

Property Protection

We take reasonable precautions to protect your property during tree work. However, customers should remove vehicles, outdoor furniture, and valuable items from work areas. Underground utilities must be marked before work begins.

Limitation of Liability

Our liability is limited to the cost of the contracted services. We are not liable for pre-existing property damage, underground utility damage not properly marked, or consequential damages beyond the direct cost of our work.

Permits and Regulations

City Permits

Customer is responsible for obtaining any required city permits for tree removal. We can assist with permit applications and provide necessary documentation, but permit fees are customer's responsibility.

Protected Trees

Some trees may be protected by local ordinances. We will advise if permits are required, but customer must ensure compliance with all local tree preservation laws before work begins.

Utility Coordination

Customer must call 811 (Dig Alert) at least 48 hours before work begins. Work near power lines requires utility company coordination, which may delay project timeline.

Warranties and Guarantees

Workmanship Warranty

We guarantee our workmanship for a period of one (1) year from completion date for stump grinding and six (6) months for tree removal cleanup. This warranty covers defects in our work under normal conditions.

Stump Grinding Guarantee

Stumps are ground to 6-8 inches below ground level unless otherwise specified. We guarantee complete stump removal to the contracted depth.

Warranty Exclusions

Our warranty does not cover:

  • Natural regrowth of vegetation
  • Settling of backfill material
  • Damage from extreme weather or natural disasters
  • Damage caused by customer or third parties
  • Root systems beyond contracted removal depth

Cancellation and Refund Policy

Customer Cancellation

Customers may cancel contracts within 72 hours of signing for a full refund of any deposits paid, provided work has not yet commenced and no equipment has been mobilized.

Cancellation After Work Begins

If cancellation occurs after work has begun, customer is responsible for payment of completed work, mobilization costs, and any equipment rental fees incurred.

Weather Delays

Tree work may be delayed due to unsafe weather conditions including high winds, storms, or icy conditions. Such delays do not constitute breach of contract and project timelines will be adjusted accordingly.

Emergency Services

Emergency tree removal services cannot be cancelled once our crew is dispatched to your location. Emergency service fees apply for after-hours and weekend calls.

Cleanup and Disposal

Standard Cleanup

All tree debris, branches, and wood will be removed from your property unless otherwise requested. We leave your property clean and ready for your next landscaping phase.

Wood and Mulch Options

Customers may request to keep firewood or wood chips at no additional charge. We can also arrange for wood chipping services to create mulch for your landscaping projects.

Free Wood Chips and Logs Program

IMPORTANT: By requesting and accepting free wood chips or logs from Divine Tree Service, you agree to the following terms and conditions. Please read carefully as these terms limit our liability and establish your responsibilities.

Program Overview

Divine Tree Service offers free wood chips and logs from our tree removal projects as a courtesy service to the community. Materials are provided "AS-IS" with no warranties or guarantees of any kind, express or implied.

Delivery Terms and Availability

By requesting free materials, you acknowledge and agree that:

  • Delivery is subject to availability and our work schedule in your area
  • We cannot guarantee specific delivery dates, times, or quantities
  • Delivery schedules are determined solely at our discretion based on active job sites
  • We may cancel or decline any request without notice or explanation
  • Material composition (species, size, moisture content) varies and cannot be guaranteed
  • Wood chips may contain mixed tree species, leaves, twigs, and other organic debris

Property Access and Site Requirements

Customer is responsible for:

  • Ensuring adequate access for our dump truck and equipment
  • Providing clear delivery location instructions and safe placement area
  • Removing vehicles, equipment, and obstacles from delivery area
  • Marking underground utilities (sprinklers, electrical, gas, water) before delivery
  • Any damage to driveways, lawns, or property from heavy equipment access
  • Obtaining any necessary HOA or property management approvals

Acceptance and Final Sale

ONCE MATERIALS ARE DELIVERED, ACCEPTANCE IS FINAL AND BINDING:

  • NO REFUNDS: Materials are free with no refunds or credits available
  • NO RETURNS: We will not remove materials after delivery for any reason
  • NO EXCHANGES: Cannot exchange for different materials or quantities
  • Customer assumes full responsibility for materials immediately upon delivery
  • Customer is solely responsible for removal, disposal, or redistribution
  • We are not responsible if you change your mind after delivery

Complete Liability Waiver

Divine Tree Service disclaims all liability for free materials delivered under this program. By accepting delivery, you waive all claims against Divine Tree Service for:

  • Material quality, composition, moisture content, or usability
  • Plant disease, pests, insects, or contaminants in wood chips or logs
  • Damage to lawns, landscaping, driveways, or property from material placement
  • Spontaneous combustion or decomposition heat from wood chip piles
  • Injury or property damage from use, storage, or handling of materials
  • Settling, compaction, or volume reduction of wood chips over time
  • Allergic reactions or health issues from contact with materials
  • Staining of concrete, pavers, or surfaces from wood materials
  • Nitrogen depletion in soil from wood chip decomposition
  • Any consequential, incidental, or indirect damages of any kind

Materials Provided "AS-IS"

Free materials are provided in their current condition with no warranties. We make no representations about:

  • Tree species, wood type, or material composition
  • Suitability for any particular purpose or landscaping use
  • Absence of disease, pests, chemicals, or treated wood
  • Consistency, size, moisture content, or decomposition state
  • Safety for use around plants, animals, or children

Customer Responsibilities After Delivery

After accepting free materials, customer is solely responsible for:

  • Moving, spreading, or redistributing materials as desired
  • Monitoring wood chip piles for heat buildup and fire risk
  • Proper disposal if materials are unwanted or unsuitable
  • Compliance with local ordinances regarding material storage
  • Any costs associated with material removal or disposal
  • Safe handling and use of materials, including protective equipment

Safety Warnings

⚠️ IMPORTANT SAFETY INFORMATION:

  • Large wood chip piles can generate heat and pose fire risk through spontaneous combustion
  • Fresh wood chips deplete nitrogen from soil - allow composting before garden use
  • Some tree species may contain allergens, irritants, or toxic compounds
  • Wood chips may harbor insects, spiders, or other pests
  • Logs may shift or roll, creating crush hazards - stack safely

Customer assumes all risks associated with accepting, storing, and using free materials. Divine Tree Service is not liable for any injuries, damages, or losses resulting from material delivery or use.

Right to Refuse or Cancel

We reserve the right to refuse delivery or cancel any request if we determine site conditions are unsafe, access is inadequate, or delivery would pose risks to our equipment or personnel. No compensation or alternative arrangements will be provided for cancelled deliveries.

Indemnification

By accepting free materials, you agree to indemnify, defend, and hold harmless Divine Tree Service, its owners, employees, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from your acceptance, possession, use, or disposal of free materials.

Agreement to Terms:

By submitting a request for free wood chips or logs through our website or by accepting delivery of materials, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions outlined in this section. If you do not agree to these terms, do not request or accept free materials.

Dispute Resolution

Good Faith Resolution

We are committed to resolving any disputes in good faith. Please contact us immediately with any concerns so we can address them promptly and professionally.

Governing Law

These terms are governed by the laws of the State of California. Any legal proceedings will be conducted in Sacramento County, California.

Licensing and Compliance

Divine Tree Service is a licensed tree care contractor in the State of California. We comply with all applicable safety regulations, environmental requirements, and local ordinances.
